Terms of Service

1. Eligibility

You must be at least 18 years old to use MustTry. We do not knowingly allow anyone under 18 to use the Service. By creating an account, you represent that you are 18 or older. LIVE check-in and location features are intended for adult users only. You may not use the Service where prohibited by law. Additional safety information is at https://musttry.ai/safety.

2. Your account

You are responsible for your account credentials and for activity under your account. Provide accurate information and keep it updated. Notify us at support@musttry.ai if you suspect unauthorized access.

• You may sign up with email, Sign in with Apple, Google, or other methods we support.
• You may update your vibe persona and favorite tags in the app, including by retaking the vibe quiz.
• You may not impersonate others, use another person’s account without permission, or create accounts for abusive or automated purposes.

3. The Service

MustTry lets you discover places, check in, go LIVE at a location (subject to location verification), share optional LIVE media (photos, short video clips, or 360° spot views), save spots, rate places, build streaks for certain activity, connect with friends, and see friend activity according to privacy and audience settings. Features may change; we may add, modify, or remove features with or without notice.

• LIVE clips and 360° content are intended for short-lived sharing with friends and may expire after a limited period (typically about 24 hours).
• 360° capture may use your camera and device sensors; uploaded panoramas must be content you have the right to share.
• Streaks and similar features are for personal motivation only and have no cash value.

4. Acceptable use

You agree not to:

• Harass, threaten, defame, or harm others, or post unlawful, hateful, or sexually explicit content.
• Share false location check-ins intended to mislead friends or abuse LIVE verification.
• Upload LIVE clips, photos, or 360° imagery that invades others’ privacy, depicts minors inappropriately, or you do not have permission to share.
• Record or publish 360° or video content in private spaces (such as restrooms or changing areas) or where recording is prohibited.
• Scrape, reverse engineer, or overload our systems without permission.
• Use the Service for spam, unsolicited friend requests at scale, or commercial solicitation without our consent.
• Circumvent blocks, security, or subscription limits.
• Violate others’ intellectual property or privacy rights.
• Violate our Community Guidelines (https://musttry.ai/community), including rules on minors, harassment, and inappropriate LIVE or 360° content.

5. Your content

You retain ownership of content you submit (profile information, ratings, comments, photos, video clips, 360° images, and similar media). You grant MustTry a non-exclusive, worldwide, royalty-free license to host, store, process, display, and distribute that content solely to operate and promote the Service (including showing your activity to friends as your settings allow and for the duration features are designed to retain such content).

You represent that you have the rights to any media you upload and that it does not violate these Terms or applicable law.

You are responsible for your content. We may remove content or suspend accounts that violate these Terms, the Community Guidelines, or that we reasonably believe harm the community.

6. Community Guidelines and content moderation

Our Community Guidelines (https://musttry.ai/community) describe acceptable behavior for a social app with photos, locations, and friend activity. They are incorporated into these Terms.

MustTry is a user-generated content platform. We provide report and block tools; we review reports and may use automated signals to detect abuse. We are not obligated to pre-screen all content but we may remove content, restrict features, or terminate accounts at our discretion, especially for safety risks involving minors, harassment, illegal content, or repeat violations.

7. Friends, blocking, and safety

Friend connections are mutual unless otherwise stated. You may block users; blocked users should not appear in your discovery or feeds. We provide tools to control friend requests and LIVE visibility, but we do not guarantee every user will behave appropriately. Use caution when meeting people from any online service.

8. Location and LIVE

When you go LIVE, you choose who can see your session. Location may be verified against a place before sharing. You may optionally attach a status photo, short clip, or 360° view; friends with permission may view and interact with that media as described in the app.

You are responsible for sharing only what you are comfortable with and for respecting others when capturing video or 360° imagery in public or private places. MustTry is not an emergency or safety service — do not rely on it for urgent help.

9. Premium Plan and subscriptions

Some features require a paid “Premium Plan” subscription billed through Apple’s App Store. Payment, renewal, cancellation, and refunds are handled by Apple under Apple’s terms. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period in your Apple ID subscription settings.

Restore purchases using the in-app control if you reinstall or change devices. Feature limits for free users (such as feed caps or LIVE delay) are described in the app and may change.

10. Third-party services

The app may link to maps, websites, sign-in providers, place data providers (such as Google Places), or load third-party scripts in embedded viewers (for example to display 360° panoramas) that we do not fully control. Your use of those services is subject to their terms. Place information may come from third-party or community sources; we do not guarantee accuracy, hours, or safety of any venue.

11. Intellectual property and DMCA

MustTry’s name, logo, app design, and our content (excluding your user content) are owned by us or our licensors. You may not copy, modify, or distribute them without permission.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. 360° AND VIDEO FEATURES MAY BE INACCURATE, INCOMPLETE, OR TEMPORARILY UNAVAILABLE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUSTTRY AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

14. Indemnity

You agree to indemnify and hold harmless MustTry from claims arising out of your use of the Service, your content (including LIVE clips and 360° media), or your violation of these Terms or others’ rights, except where prohibited by law.

15. Termination

You may stop using MustTry at any time. We may suspend or terminate your account if you breach these Terms or for operational or legal reasons. Sections that by nature should survive (disclaimers, liability limits, indemnity, governing law) will survive termination.

16. Disputes and governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country require otherwise. Any dispute will be resolved in the state or federal courts located in California, unless applicable law requires a different forum.

17. Changes to Terms

We may update these Terms. We will post the revised Terms with a new “Last updated” date. Material changes may be communicated in the app. Continued use after changes constitutes acceptance.
